These terms of sale apply to all goods supplied by Smart Equine Limited. By ordering and/or registering online via Smart Equine’s website you automatically agree to be bound by them. We may change these terms and conditions from time to time by updating this page.

1. Orders

Any order placed by you for goods advertised on our website, social media or via our marketing literature or at a show is an offer by you to purchase the goods selected in your order. No contract shall exist between you and Smart Equine for the sale of any goods until we have received your order and accepted it by email or telephone (which we may do at our discretion) and corresponding invoice sent by Smart Equine to you, the customer. For online orders, confirmation of order exists upon receipt of payment.

If we cannot accept your order (for example (but without limitation) because the goods are found to be unavailable) we will notify you by telephone or email.

Sizes and designs of goods being ordered should be checked carefully by you to ensure they will meet your requirements before an order is placed as Smart Equine will not be liable to exchange goods that have been ordered incorrectly. Smart Equine is entitled to withdraw from any contract in case of errors or inaccuracy regarding the goods or the order appearing on the site. Smart Equine reserves the right to alter prices, colours, designs and specifications at any time should it be necessary to do so. The contract is subject to your statutory right of cancellation.

2. Availability

Due to the vast range of colours, designs and sizes of goods available through Smart Equine, we cannot guarantee availability of all product, size and colour options at all times. We endeavour to keep key items in stock year round, but should an item required be sold out, we will be able to inform you of likely time scale for reorder. 3. Pricing

All prices are quoted ex-works (excluding delivery) in Euro and are exclusive of VAT at the standard Irish rate.

Custom orders may be priced and agreed with the customer on an individual basis.

4. Delivery

The easiest and most cost effective way to access Smart Equine products is through collection from our base at Killossery Lodge Stud, North Dublin. We have several delivery options:

  1. Click and collect – purchase any in stock products either online, over the phone or via email and collect at your convenience from Killossery Lodge Stud, Rolestown, Dublin K67 F210.
  2. DPD Courier Delivery Service – available on a limited range of products – soft poles, water trays, pole tidies and cups.
  3. Truck Courier Service – we can quote for delivery for any products for our entire range to anywhere on the island of Ireland. Please contact us for a quote.

All deliveries made via courier must be carefully checked and signed for as Smart Equine cannot be liable for any damages or shortages if goods have been signed for as received in full and in good condition.

Orders placed online will show at checkout whether goods must be collected from Smart Equine at Killossery Lodge Stud, or give an option of courier delivery service.

Please note we cannot deliver outside the island of Ireland.

Please note accurate eircodes are required for courier deliveries and delivery to fields or similar places without eircodes will not usually be possible.

4. Payment

All prices are in euro and exclusive of vat, which will be calculated at checkout or indicated on invoice. All goods must be paid for in full before collection or dispatch. Any orders that include custom items will require full payment at the time of ordering. Pre-ordered items for delivery on our next container require 50% deposit to secure order.  Our preferred method of payment is bank transfer, with bank details as indicated on invoice. Secure on-line payment is offered for online orders. Cheques will be accepted but goods cannot be dispatched or collected until full payment has cleared. Goods remain the property of Smart Equine until paid for in full.

5. Returns

You can return any of the goods received from Smart Equine provided they are unused and in their original condition and packing or packing of similar quality and protection to prevent damage in transit. Any items should be returned within 14 days from the date of dispatch. Smart Equine does not use a freepost service for returned items. Delivery and insurance for returning items to Smart Equine will be at the expense of the sender. Smart Equine will refund or exchange the cost of the goods but is unable to refund the delivery charge for dispatching the goods. If items have been made specifically to order for a client, then return is not possible except should a fault be found with the goods.  Smart Equine has the right to recover all reasonable expenses involved with designing and manufacturing any custom item. Smart Equine will not be held responsible for items damaged or lost while being returned to it. This returns policy does not affect your statutory rights.

7. Intellectual Property Rights

7.1 Copyright: All rights reserved. Text, images, graphics, sound, animations, and videos as well as the arrangement of the same on Smart Equine websites are protected by copyright and other commercial protective rights. The content of these websites may not be copied, disseminated, altered, or made accessible to third parties for commercial purposes. In addition, the Smart Equine website may contain images that are subject to third-party copyrights.

7.2 Trade marks: Unless specified otherwise, all trademarks on Smart Equine websites are protected by trademark law. The brands and design elements used on our pages are the intellectual property of Smart Equine Ltd.

7.3 You acknowledge that Smart Equine own or are licensed to use all copyright, database rights, trade marks and other intellectual property rights in and to all parts of this web site and the business of Smart Equine (including the structure design and layout of the web site) and assert all such rights worldwide.

7.4 You are entitled to use our web site in accordance with these terms and conditions. You must obtain Smart Equine’s prior written consent before you use the web site or any part of it in any other manner.

8. Liability

8.1 Smart Equine attempts to ensure that the information available on the web site at any one time is accurate. However we cannot guarantee that it will be free of fault.

8.2 Smart Equine does not accept liability for any errors, omissions and/or admissions and reserves the right to change information, specification and description of listed goods, and products at any time.

8.3 Smart Equine does not make any warranty that the web site is free from infection by virus or anything else that has contaminating or destructive properties.

8.4 Smart Equine does not accept liability for any losses or claims arising from any inability to access the web site, or any failure to complete a transaction.

8.5 Smart Equine does not accept liability for any indirect or consequential loss of any kind in contract, tort or otherwise arising out of use of the web site for any products or services purchased from the web site.

8.6 Smart Equine will only be liable for direct loss up to a maximum total of the price of the product purchased in respect of any claim.

8.7 Any equine activity by the very nature of the sport incorporates an element of risk. Jumping has the potential to increase that risk. All Smart Equine products are supplied as mobile training or competition obstacles. The onus is upon the person using Smart Equine products to ensure they are using and setting up the jumps in a suitable manner for the particular rider and situation, and adhering to any rules and regulations that may apply to the particular setting in which they are being used, and Smart Equine assumes no responsibility or liability for the same.

8.8 Smart Equine, its owners and agents assume no responsibility whatsoever beyond the total cost of the purchased product. The Purchaser of the product and subsequent users of the product assume all responsibility for the use of the product up to and including any injury and/or death associated with the use of such product(s).

8.9 This liability section applies only to the extent permitted by law.

9. General

9.1 These Terms and Conditions do not confer or purport to confer on any third party any benefits or any right to enforce any terms into any contract made with Smart Equine.

9.2 Smart Equine will not be liable for any delay in or failure to perform obligations if that delay or failure is caused by circumstances beyond their control.

9.3 Time shall not be of the essence in the performance of this Agreement.

9.4 If for any reason any provision of these terms and conditions is unenforceable, the validity of the remaining provisions shall not be affected.

9.5 The terms and conditions and contracts between you and Smart Equine shall be governed by English law and all disputes shall be submitted to the jurisdiction of the English courts.

9.6 Dynamic price calculation maybe unsupported in your browser platform. Final price calculation will take place in your shopping basket. Smart Equine reserves the right to alter its prices in any order placed online or otherwise if the prices shown on the website or literature are incorrect. Smart Equine’s website and literature is updated regularly and out of date prices will not be honoured.
